Terms of Service

Meridian Estates ("we", "us", "our") runs meridianestates.co.ke (the "Service"). The Service is an online marketplace in Kenya. It lets agents, landlords and owners advertise homes and land, and lets house hunters find them. By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

• We show listings and pass enquiries between house hunters and the people who list.
• We do not own, manage, rent out or sell the properties shown. The person who posts a listing is responsible for it.
• We do not inspect properties, check documents, or check the identity of agents, landlords or house hunters. We do not vouch for anyone on the Service.
• We do not collect rent, deposits or purchase money, and we do not hold money on anyone's behalf.
• We are not a party to any agreement you make with another user. Any tenancy, sale or commission deal is between you and them.

• You must be at least 18 years old to create an account.
• Give true details and keep them up to date.
• Keep your password safe. You are responsible for what happens in your account.
• One person or business may hold one agent account. Opening extra accounts to get around plan limits is not allowed, and we may review, suspend or merge such accounts.

If you post a listing, you confirm that:

• The property is real, in Kenya, and available, or you will remove it when it is not.
• You have the owner's permission to advertise it.
• The price is shown in KES and is the true asking price.
• The photos show the actual property and you have the right to use them.
• The description is honest and does not leave out important facts.

Listings are reviewed before going live and may be sent back for changes. To protect privacy, public pages show the area, not the exact address. We may edit, hide or remove any listing that breaks these Terms, at our discretion.

• Post fake, duplicate or misleading listings, or bait prices.
• Ask house hunters to pay viewing fees or deposits before they have seen a property.
• Harass, threaten or spam other users, including on WhatsApp or by phone.
• Copy, scrape or resell listings or contact details from the Service.
• Try to break, overload or get around the security of the Service.
• Break any Kenyan law, including the Data Protection Act, 2019.

When you send an enquiry or complete the Find My Home quiz, you agree that we may share your name, phone number and answers with agents, landlords or owners whose listings may suit you, so they can contact you. Agents who receive your details may only use them to help with your home search. How we handle personal data is explained in our Privacy Policy.

• Every agent can list a small number of homes for free. Paid plans add more features.
• Current plan prices and features are shown on our plans page and may change over time.
• Paid plans are billed monthly and paid by M-Pesa to the number shown on the plans page.
• If a payment is late, there is a short grace period. After that, extra listings are hidden and paid features are locked until payment is made.
• You can stop paying at any time. Your plan then ends at the close of the paid month.
• Payments already made are not refunded, except where Kenyan law requires it or we agree otherwise in writing.
• A paid plan gives access to tools and features. It does not promise any number of leads, enquiries, viewings or deals.

You keep ownership of the photos and text you upload. You give us a non-exclusive, royalty-free licence to show, resize, watermark and share that content on the Service and in our marketing, such as social media posts, for as long as it is on the Service. You can remove your content at any time.

Some pages may show ads from third parties. We are not responsible for the products or websites in those ads.

The Service is provided "as is". We work to keep it accurate and running, but we cannot promise it will always be available or error free. Always view a property and check the documents yourself before paying any money.

As far as the law allows, we are not liable for losses that come from dealings between users, from listings posted by others, or from the Service being unavailable. Where we are liable, our total liability is limited to the amount you paid us in the three months before the claim. Nothing in these Terms limits rights you have under the Consumer Protection Act, 2012.

We may suspend or close an account, or hide its listings, if it breaks these Terms or puts other users at risk. You can close your account at any time by contacting us.

If you see a fake listing, a scam attempt, or anything that breaks these Terms, tell us on WhatsApp or by email. We will look into it.

We may update these Terms from time to time. We will change the effective date at the top of this page. If you keep using the Service after a change, you accept the new Terms.

These Terms are governed by the laws of Kenya. We will first try to settle any dispute by talking with you. If that does not work, the courts of Nairobi will decide.
