Estate agent commission in Kenya: how to protect yours
Most lost commission comes from nothing agreed in writing. Four steps so you get paid for the work you do.
By Meridian Estates. Updated
Many agents in Kenya lose commission because nothing was agreed in writing.
This guide covers the basics so you get paid for the work you do.
It is general information, not legal advice.
Step 1
Know the law
In Kenya, estate agency is governed by the Estate Agents Act (Cap. 533). The Act sets up the Estate Agents Registration Board and requires people who practise as estate agents to be registered.
Being registered helps you if you ever need to claim commission formally.
Step 2
Agree in writing before you work
A WhatsApp chat is better than nothing, but a short signed letter is better. Before you bring anyone to a property, agree on these points with the landlord, management or seller.
- How much is the commission?
- Who pays it?
- When is it paid? On signing, on payment, or on move in?
- What proof do they need that the client came from you?
Step 3
Register your client before the viewing
Before a viewing, send the landlord or management the client's name and the date of the viewing. Keep a copy.
If the client goes back alone later, you have a record that you introduced them.
Step 4
Keep your records in one place
Write down every client, every viewing and every agreement. On Meridian Estates you can keep notes on each lead in your account, so you know who you showed and when.
